1. Introduction

Welcome to Herit360! These Terms and Conditions (the “Terms”) are a binding agreement between you and Herit360 (referred to as “Herit360,” “we,” “us,” or “our”), a company registered in Ghana. Herit360 is a panAfrican digital platform that connects users with local hosts, vendors, and service providers offering a variety of experiences and services – from hotels and tours to events, dining, transportation, shopping, and more. By accessing or using the Herit360 mobile application or website (collectively, the “Platform”), you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, do not use the Platform. These Terms govern your use of the Platform and all Herit360 services. Additional policies referenced herein (such as our Privacy Policy and Cookie Policy) also apply to your use of Herit360.

 

2. Eligibility and Accounts

Eligibility. Herit360 does not impose a strict minimum age requirement to open an account. However, if you are under the legal age of majority in your jurisdiction, you may use the Platform only with the consent and under the supervision of a parent or legal guardian. By using the Platform, you represent that you have the capacity to enter into a binding contract or have obtained guardian consent, and that you will abide by these Terms. If you are using the Platform on behalf of an entity (e.g., as part of a business, organization, or community group), you represent that you have authority to bind that entity to these Terms.

Account Registration. To access many features of the Platform, you must create a Herit360 account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. This includes your name, contact details (email and phone number), and any other information we require. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security. You must safeguard your password and not share it with any third party. If you suspect any unauthorized use of your account or any security breach, notify us immediately at support@herit360.com. Herit360 is not liable for any losses or damages arising from your failure to keep your account secure.

Account Restrictions. You may only register one account for personal use unless Herit360 expressly permits otherwise. You may not transfer, assign, or sell your account to another party without our consent. We reserve the right to suspend or terminate your account if any information provided during registration or thereafter is inaccurate, fraudulent, or violates these Terms.

 

3. The Herit360 Platform and Services

Nature of the Platform. Herit360 provides an online marketplace that enables users (“Guests”) to discover and book various heritage and tourismrelated services offered by hosts or vendors (“Vendors”). Vendors are independent thirdparty providers such as hotel owners, tour guides, event venue operators, local artisans, transportation providers, and others. Herit360 itself does not own, manage, or operate the accommodations, tours, events, or other services listed on the Platform; instead, we facilitate connections and transactions between Guests and Vendors.

Role of Herit360. Herit360 acts solely as an intermediary platform. This means that when you make a booking or purchase through Herit360, you enter into a direct agreement with the Vendor responsible for delivering that service or product. Herit360 is not a party to the underlying agreement between you (as a Guest) and the Vendor. We do not guarantee or endorse the quality, safety, legality, or suitability of any accommodations, products, or experiences provided by Vendors, and we do not supply any such services ourselves. All content related to listings—descriptions, photos, pricing, availability, and other information—is provided by the Vendors. While Herit360 may verify certain Vendors or listings for trust and safety (for example, verifying identity, certifications, or reviews for “verified hosts and vendors”), we do not guarantee that all information is accurate or that any particular Vendor will meet your expectations. You should exercise your own judgment regarding the individuals, entities, and listings you interact with via the Platform.

User Responsibilities. When you book a service or experience through Herit360, you agree to comply with any terms, conditions, or rules set by the Vendor of that service in addition to these Terms. For example, hotels may have checkin requirements, tour guides may require you to follow safety guidelines, event venues may have capacity or usage rules, and product vendors may have specific purchase terms. You agree to honor any such additional requirements and to interact in good faith. If you have any health, mobility, or other special requirements, you are responsible for communicating these to the Vendor prior to booking to ensure the service is suitable for you.

Host/Vendor Responsibilities. If you are a Vendor listing services on Herit360, you must abide by these Terms and any Vendor guidelines provided by Herit360. You represent and warrant that you have all necessary rights, licenses, permits, and authority to offer and provide the services or products you list. You agree to provide complete and accurate information about your listing (including pricing, availability, location, conditions, and any rules or requirements for Guests) and to fulfill any booking or order in accordance with your listing’s description. You are responsible for your own acts and omissions and are solely liable for any claims, injuries, damages, or liabilities arising from your provision of services to Guests. Vendors must comply with all applicable local laws and regulations (for example, obtaining tourism licenses, business registrations, health and safety certifications, or complying with Ghana Tourism Authority rules). Herit360 reserves the right to remove or suspend any listing that, in our judgment, violates these Terms or could adversely affect the Platform or its users.

4. Booking, Payments, and Fees

Booking Process. When you, as a Guest, request or initiate a booking for a service (such as reserving a hotel stay, booking a tour, purchasing an event ticket, renting a vehicle or boat, or ordering a product), you may be required to agree to specific terms and conditions of the Vendor (such as house rules, participation requirements, or cancellation policies) before completing the booking. A booking is considered confirmed when you receive a confirmation through the Herit360 Platform (via email, app notification, or on the website). At that point, a direct contract is formed between you and the Vendor. Herit360 also sends the Vendor a booking confirmation. Both Guests and Vendors are expected to honor confirmed bookings.

Prices and Currency. Prices for listings are typically displayed in Ghanaian Cedis (GHS) for consistency, regardless of where you are browsing from. However, for international transactions, your payment might be processed in another currency. For example, if you pay with a nonGhanaian credit or debit card, the charge may be processed in U.S. Dollars (USD) or another currency, and your card provider will convert the amount from GHS to that currency at the applicable exchange rate. (Your bank or card issuer may charge foreign transaction fees or use a different exchange rate; Herit360 does not control these fees.) Domestic users in Ghana may have the option to pay in GHS via local methods such as Mobile Money or local bank cards. The applicable currency and total price will be shown at checkout before you confirm payment.

Payment Processing. All payments are processed through Paystack, a trusted thirdparty payment provider. Herit360 does not directly process, collect, or store your payment details. By making a booking or purchase, you authorize Paystack to charge the full amount of the booking (including the listing price, service fees, taxes, and any other disclosed charges) to your selected payment method. Paystack uses secure, encrypted payment technologies to handle transactions. In some cases—especially for services scheduled in the future—Paystack may place a temporary hold on your payment method when you initiate a booking request. The hold will be captured when the booking is confirmed. For certain services scheduled in advance, funds may be held in escrow and only released to the Vendor after the service has been rendered (for example, releasing payment after a Guest check in or after a tour date). Herit360 does not assume any liability for payment delays or errors attributable to Paystack or your financial institution.

Service Fees. Herit360 may charge Guests a service fee and/or charge Vendors a commission or listing fee for use of the Platform. Any such fees will be clearly disclosed at the time of booking or listing. For example, Guests might pay a small percentage extra as a booking fee, or Vendors may have a percentage of their payout withheld as a platform fee. These fees help us operate the Platform, provide customer support, ensure secure payment processing, and deliver other benefits. By confirming a booking, you agree to any applicable fees shown. Service fees (if charged to Guests) are generally nonrefundable unless otherwise stated.

Taxes. Vendors are responsible for determining and including any applicable taxes (such as VAT, sales tax, occupancy tax, tourism levies, and similar charges) in their listing prices or for informing Herit360 of any taxes that need to be collected from Guests. Where required by law or agreement, Herit360 may collect certain taxes from Guests on behalf of Vendors and remit those taxes to the appropriate authorities. Any tax amounts we collect will be shown to you during checkout. Herit360 itself is not liable for determining taxes on a Vendor’s behalf, but we reserve the right to calculate and add tax charges where required by law.

Cancellations and Refunds. Cancellation policies may vary depending on the type of service and the Vendor’s terms. When booking a service, you should carefully review the cancellation policy provided in the listing or during checkout. Some bookings might be fully refundable if canceled a certain number of days in advance, partially refundable, or nonrefundable. If you cancel, any refund will be determined by the applicable cancellation policy and processed by Paystack on behalf of Herit360. For business Vendors (hotels, established tour operators, etc.), the Vendor may set its own cancellation policy, which will apply. For private Vendors (individual hosts), Herit360 adopts a system similar to Airbnb’s cancellation categories (such as Flexible, Moderate, and Strict). Vendors should choose the appropriate policy category when listing their services. If a Vendor needs to cancel a confirmed booking, they must do so only for unavoidable reasons. If a Vendor cancels, the Guest will receive a full refund for that booking. Herit360 may assist the Guest in finding alternative accommodations or services where possible, though we cannot guarantee that alternatives will be available. Repeated or lastminute Vendor cancellations may result in penalties or account consequences.

No Circumvention. All bookings of services found through Herit360 must be completed through the Herit360 Platform. You agree not to circumvent the Platform by arranging with a Vendor or Guest to provide or purchase a listed service outside of Herit360. Engaging in offplatform transactions (to avoid fees or otherwise) may lead to account suspension. Vendors should not solicit Guests to pay or book outside the Platform, and Guests should report any attempt to do so by contacting support.

Payment Issues. In the event of payment failures, chargebacks, fraud alerts, or suspected suspicious activity, Herit360 reserves the right to cancel the associated bookings and/or suspend the involved accounts. You agree to cooperate in resolving any payment issues and to provide updated payment information if your initially provided payment method fails. Herit360 is not responsible for payment disruptions due to bank or card network issues, currency fluctuations, or thirdparty payment processor errors.

5. User Conduct and Prohibited Activities

Herit360 strives to maintain a safe and respectful community. By using the Platform, you agree not to engage in any of the following prohibited activities:

1.     Illegal Activities. Do not use the Platform for any purpose that is illegal or prohibited by law. You agree not to violate any applicable laws or regulations, including local ordinances. You must not use Herit360 to engage in money laundering, promote terrorism, or participate in human trafficking or exploitation of persons.

2.     False or Misleading Content. Do not post or provide any information that is false, misleading, or fraudulent. This includes making bookings or requests under false pretenses, posting reviews that are not based on genuine experiences, or misrepresenting your identity or affiliation.

3.     Harassment and Discrimination. You will not harass, threaten, or defame any person or entity on the Platform. Discriminatory behavior or content (for example, based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic) is strictly prohibited. Vendors must not reject or select Guests in a discriminatory manner, and Guests must not engage in abusive behavior toward Vendors or other users.

4.     Interference with the Platform. Do not interfere with the proper operation of the Platform. This includes refraining from hacking, scraping, or any automated means of accessing data without our permission. You agree not to upload or transmit viruses, malware, or any destructive code and not to attempt to bypass any security or access controls.

5.     Unauthorized Commercial Use. The Platform is for personal and approved business use only (for legitimate Vendors). You will not use Herit360 to advertise unrelated products or services or send unsolicited bulk communications (“spam”) to other users. You may not use the Platform to recruit or poach Vendors or Guests for competing platforms.

6.     Privacy Violations. You will not scrape, harvest, or collect data about others without their consent. You must not share another person’s personal information obtained through the Platform with third parties, except as necessary to consummate a booking. Additionally, you will not record or photograph individuals on experiences without their consent where such consent is required by law.

7.     Content Standards. If you post any content (such as reviews, photos, descriptions, or profile information), it must be appropriate, lawful, and relevant to the purpose of the Platform. You agree not to post content that is obscene, pornographic, violent, or promotes illegal activities. Any content that includes hate speech, incitement of violence, or exploitation of minors is strictly forbidden.

8.     Multiple Accounts and Manipulation. You will not create multiple accounts for dishonest purposes or to subvert our rules. You may not manipulate any ranking, review, or feedback system, such as by instructing a third party to leave a positive review for your own listing or a negative review for a competitor.

Herit360 reserves the right to investigate and prosecute violations of any of the above to the fullest extent of the law. We may take any actions we deem necessary and appropriate for any misconduct, including suspending or terminating your account, removing content, canceling bookings, or involving law enforcement authorities. If you witness or experience behavior that violates these standards or makes you feel unsafe, please contact us at support@herit360.com.

 

6. UserProvided Content and Intellectual Property

Your Content. Herit360 may allow users and Vendors to create, upload, or share content such as profile pictures, descriptions, reviews, ratings, comments, photos, videos, or other materials (collectively, “User Content”). With respect to ordinary textual content (for example, reviews or descriptions), you grant Herit360 a worldwide, royaltyfree, sublicensable, and transferable license to use, reproduce, modify (for formatting or technical purposes), distribute, publish, and display that content on our Platform and in any promotional or marketing materials. You retain any intellectual property rights you hold in that textual content, subject to this license.

Images and Videos Become Property of Herit360. For any images, videos, or other media you upload to the Platform—whether as a Vendor showcasing a listing or a user sharing an experience—you agree that such media becomes the exclusive property of Herit360 upon upload. This means that Herit360 owns all intellectual property rights in the images and videos you upload, and Herit360 may use, reproduce, modify, distribute, and display them for any purpose, including marketing and promotional activities, without owing you further compensation. If you do not wish to transfer ownership of your media to Herit360, do not upload it.

Content Guidelines. You represent that you own or have the necessary rights to any User Content you post. You may not upload content that infringes on the intellectual property or privacy rights of others. For example, Vendors should use only photographs of accommodations or experiences that they have taken themselves or have rights to use. Users posting reviews should not include copyrighted text from other sources without permission. If your content includes personal data of others, you must have that person’s consent.

Review Moderation. The Platform may include a review system where users can rate and review their experiences. Reviews should be accurate and fair. We do not generally edit reviews for content, except that we may remove or redact personal information, profanity, or other content that violates our guidelines (such as hate speech or spam). Herit360 does not guarantee the truth or accuracy of reviews; reviews reflect the opinions of individual users, not of Herit360. We are not responsible for any claims or statements made in reviews, but we reserve the right to remove reviews that violate our policies or these Terms.

Removal of Content. Herit360 reserves the right, but has no obligation, to remove or disable access to any User Content that we believe, in our discretion, violates these Terms or is otherwise harmful, objectionable, or illegal. We may do this without prior notice. In such cases, we may notify the user who provided the content with the reason for removal, unless notice would be legally inadvisable or the user is a repeat violator.

Intellectual Property of Herit360. All content and materials on the Platform (excluding User Content described above) are the property of Herit360 or its licensors and are protected by copyright, trademark, and other intellectual property laws. This includes the Herit360 name, logo, and all design, text, graphics, images, software, and other content created or provided by us (“Herit360 Content”). You may not use, copy, distribute, or create derivative works from any Herit360 Content without our express written permission, except as allowed under these Terms (for example, to use the Platform for your personal or business use related to Herit360 services).

Feedback. If you choose to provide suggestions, ideas, or other feedback to Herit360 (for example, improvements to the Platform), you acknowledge that we may use and implement such feedback without obligation to compensate you. You grant us a perpetual, irrevocable, royaltyfree license to use your feedback for any purpose.

Copyright Infringement Policy. Herit360 respects intellectual property rights and expects users to do the same. If you believe that any content on the Platform infringes your copyright or other intellectual property rights, please notify us by contacting support@herit360.com with the subject “IP Infringement Notice” and provide details supporting your claim (including identification of the content and proof of your rights). We will review such notices promptly and remove or disable content where required. We may also terminate the accounts of repeat infringers when appropriate.

 

7. Disclaimers and No Warranty

Use at Your Own Risk. The Herit360 Platform, and any content, information, or services provided through it, are provided on an “as is” and “as available” basis, without warranties of any kind. Herit360 disclaims all explicit or implied warranties to the fullest extent permitted by law, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the Platform will be uninterrupted, errorfree, or secure at all times, nor do we guarantee the accuracy or reliability of any content or information provided on the Platform.

ThirdParty Services and Vendor Offerings. You acknowledge that the services you book or purchase via Herit360 are provided by independent Vendors, not by Herit360. We make no warranty regarding the quality, safety, legality, or satisfaction of any accommodations, events, tours, products, transportation, or other experiences obtained through the Platform. Any claims or liability arising from those services lie solely with the responsible Vendor, not with Herit360. For example, we cannot guarantee (and expressly disclaim any warranty) that: a hotel you book will be suitable or free of issues; a tour will meet your expectations; a product purchased will meet quality standards; or that a Vendor will meet you on time. While we strive to vet and curate trustworthy experiences, you bear the risk of using the services of third parties booked through our Platform.

No Guarantee of Continuous Service. Access to the Platform may occasionally be unavailable or limited due to maintenance, upgrades, or events beyond our control (such as internet outages or force majeure). We do not warrant that the Platform will function without delays, failures, or imperfections. We will make reasonable efforts to inform users of significant outages or downtimes, but we are not liable for any losses due to Platform unavailability.

No Other Warranties. No advice or information (oral or written) obtained from Herit360 or through the Platform creates any warranty not expressly stated in these Terms. You assume full responsibility for the choices you make before, during, and after using the Platform. For example, you are responsible for deciding which Vendor to book with or which Guest to accept, and you do so at your own discretion and risk. We encourage safe practices (such as reading reviews, communicating through our secure messaging, and exercising common sense), but we cannot guarantee any particular outcome. Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you if prohibited by law.

8. Limitation of Liability

To the maximum extent permitted by law, Herit360 (and its officers, directors, employees, agents, and affiliates) shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, or any loss of profits, revenue, data, goodwill, or other intangibles arising out of or in connection with your use of the Platform or any services booked through the Platform. This limitation applies to any damages arising from: (i) your use of or inability to use the Platform; (ii) any conduct or content of any other user or third party on the Platform; (iii) any service or product obtained through the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content. In no event will Herit360’s total aggregate liability for all claims arising out of or relating to these Terms or the use of the Platform exceed the amount of fees (if any) that you paid to Herit360 for transactions in the three (3) months prior to the event giving rise to liability, or USD $100, whichever is greater. If you have not paid any fees to Herit360 in that time, our liability is limited to the maximum extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages (for example, liability for personal injury or death caused by negligence), so the above limitation may not apply to you fully. In such cases, and only to that extent, Herit360’s liability will be limited to the smallest amount permitted by applicable law.

 

9. Indemnification

You agree to indemnify, defend, and hold harmless Herit360 and its affiliates, officers, directors, agents, partners, and employees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) that arise out of or relate to: (a) your breach of these Terms or of any other agreement or policy incorporated by reference; (b) your misuse of the Platform or any service obtained through the Platform; (c) your violation of any law or regulation or the rights of any third party (such as intellectual property, privacy, or other rights) in connection with your use of Herit360; or (d) if you are a Vendor, your ownership or operation of the services you offer (including any injuries, losses, or damages to users that occur on your property or under your guidance). Herit360 reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense. This indemnity obligation shall survive the termination of these Terms and your use of the Platform.

 

10. Termination and Suspension

By You. You may stop using the Herit360 Platform at any time. You may also delete your Herit360 account by following the procedures on the Platform or by contacting us at support@herit360.com. Deleting your account will terminate your ability to log in and use our services. Note that even after you delete your account, we may retain certain information as required by law or for legitimate business purposes (see the Privacy Policy for details). Also, terminating your account will not cancel any confirmed bookings you may have; if you wish to cancel bookings, you must do so separately (cancellation terms will apply).

By Herit360. We may suspend or terminate your account and/or access to the Platform, at our sole discretion, with or without cause or notice, at any time. Some examples of when we might do this include: if you violate these Terms or any applicable law; if we believe you have engaged in fraudulent activities or misconduct on the Platform; if you pose a safety or legal risk to others; or if your account is inactive for an extended period. We may also implement temporary suspensions (for example, during an investigation of user conduct or pending verification of information).

Effect of Termination. If your account is terminated or suspended by us, you do not have a right to restoration of your account or any of your User Content (though we may allow you to download certain content, like your personal data, if requested and appropriate). We may refuse to let you register a new account in our discretion. If we terminate due to your breach or misconduct, we may cancel any upcoming bookings without refund to you (in which case Vendors will not be paid for those bookings, and we may refund the affected Guests). If we terminate without cause (for example, if we are discontinuing the Platform service entirely), we will refund any prepaid amounts or deposits for bookings we cancel.

Survival. Any provisions of these Terms that by their nature should survive termination—such as payment obligations, waivers, indemnity, limitations of liability, dispute resolution, and governing law—shall survive the termination or expiration of these Terms and your use of the Platform.

11. Governing Law and Dispute Resolution

These Terms and your use of the Herit360 Platform are governed by the laws of the Republic of Ghana, without regard to its conflictoflaw principles. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved as follows:

  1. Informal Resolution. If you have a dispute with Herit360 or another user, we encourage you to contact our support team at support@herit360.com to attempt to resolve the issue informally. Many disputes or misunderstandings can be resolved through our customer service.
  2. Alternative Dispute Resolution (ADR). If a dispute cannot be resolved informally, you agree to submit the dispute to alternative dispute resolution in accordance with the Alternative Dispute Resolution Act, 2010 (Act 798) of Ghana. This may involve mediation or arbitration under the rules of an accredited ADR institution in Ghana. ADR proceedings will take place in Ghana unless the parties mutually agree otherwise. The ADR proceedings and any award rendered will be confidential.
  3. Court Proceedings. If the dispute is not resolved through ADR, or if ADR is not applicable, you agree to submit to the jurisdiction of the courts of Ghana for the resolution of any remaining claims. You and Herit360 agree to waive any objection based on inconvenience of forum. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief in a court of competent jurisdiction.

Consumers in other jurisdictions retain any mandatory rights afforded by local consumer protection or data protection laws. However, Ghanaian law will govern these Terms to the extent it does not conflict with such rights.

 

12. Additional Terms for Mobile App Users

If you install or use the Herit360 mobile application (the “App”) obtained through the Apple App Store or Google Play Store, the following additional terms apply:

Acknowledgement. You understand that these Terms are an agreement between you and Herit360 only, and not with Apple or Google. Apple Inc. and Google LLC (including their subsidiaries) are not responsible for the App and its content. Herit360, not the App Store provider, is solely responsible for the App, including any maintenance or support, and for addressing any claims by users or third parties related to the App.

Scope of License. Herit360 grants you a limited, nonexclusive, nontransferable, revocable license to use the App on any devices that you own or control, as permitted by the usage rules set forth in the App Store or Play Store terms. You may only use the App for your personal use, in accordance with these Terms. We reserve the right to terminate this license if you violate any provision of these Terms.

Maintenance and Support. Apple and Google have no obligation to furnish any maintenance or support services for the App. Herit360 is solely responsible for providing any support or maintenance for the App, as specified in these Terms or as required under applicable law. If you have apprelated support needs, please contact us (not Apple/Google) at support@herit360.com.

Warranty. To the extent we provide any express warranties not disclaimed in these Terms, those warranties are provided by Herit360, not by Apple or Google. In case of any failure of the iOS version of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund any purchase price for the App (if any was paid; note the Herit360 App is free). Apple, to the maximum extent permitted by law, will have no other warranty obligation with respect to the App. Similarly, Google assumes no warranty obligation for the App. As stated elsewhere in these Terms, Herit360 disclaims all other warranties to the fullest extent allowed by law.

Product Claims. You acknowledge that Apple (for iOS users) or Google (for Android users) is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App. This includes (i) any product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) any claims arising under consumer protection or similar legislation. Any such claims should be directed to Herit360, as the developer of the App.

Intellectual Property Rights. In the event of any thirdparty claim that the App, or your possession and use of the App, infringes that third party’s intellectual property rights, Herit360 (and not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. You agree to notify us promptly of any such claim.

Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a United States government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties. ThirdParty Terms of Agreement. You must comply with any applicable thirdparty terms when using our App. For example, if you are using the App on an iPhone or iPad, you must not be in violation of your wireless data service agreement when using the App (e.g., exceeding data limits or jailbreaking your device). If you use an integration that relies on a thirdparty service (such as a map service or social network login), you must comply with those thirdparty terms as well.

ThirdParty Beneficiary (Apple only). You acknowledge and agree that Apple and Apple’s subsidiaries are thirdparty beneficiaries of these Terms as they relate to the iOS App, and that Apple will have the right to enforce these Terms against you as a thirdparty beneficiary upon your acceptance of these Terms. (This clause does not apply to Google, since Google is not required to be a beneficiary of these terms.)

13. Miscellaneous

Entire Agreement. These Terms, along with the Privacy Policy, Cookie Policy, and any additional guidelines or policies Herit360 may provide, constitute the entire agreement between you and Herit360 regarding your use of the Platform. They supersede any prior agreements or communications (whether oral or written) regarding the subject matter.

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent court, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect.

No Waiver. Herit360’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. A waiver is only effective if in writing and signed by an authorized representative of Herit360.

Assignment. You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent. Herit360 may freely assign or transfer these Terms (in whole or in part) as part of a merger, acquisition, sale of business, or by operation of law, and you consent to any such assignment.

Relationship. Nothing in these Terms shall be deemed to create any agency, partnership, joint venture, or employment relationship between you and Herit360. You act on your own behalf and for your own benefit and not as an agent or representative of Herit360. (The only exception is for Hosts in relation to payment collection: in some cases Herit360 may act as the limited payment agent of a Vendor to collect payments from Guests on the Vendor’s behalf, but this is solely for facilitating transactions and not an employment or general agency relationship.)

Force Majeure. Herit360 shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, such as natural disasters, acts of government, war, terrorism, civil disturbances, strikes/labor disputes, internet or utility failures, or other force majeure events.

Changes to Terms. We may update or modify these Terms from time to time. If we make material changes, we will provide notice to users (for example, by posting the updated Terms on our site and updating the “Last Updated” date, or by sending an email or in-app notification). Continued use of the Platform after updates become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the Platform and, if applicable, cancel any outstanding bookings (subject to the cancellation policies).

Herit360 is committed to protecting your privacy and handling your personal information in an open and transparent manner. This Privacy Policy describes how Herit360 (“we,” “us,” or “our”) collects, uses, shares, and safeguards personal data obtained through our Platform (including our website and mobile app) and in the course of providing our services. It also explains your rights and choices regarding your personal information. We comply with applicable data protection laws, including Ghana’s Data Protection Act, 2012 (Act 843). Additionally, if you are located outside Ghana, we will take steps to comply with relevant privacy laws of your jurisdiction to the extent required (for example, certain principles of the EU General Data Protection Regulation apply to data of individuals in the European Economic Area).

By using the Herit360 Platform or providing us with personal information, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please discontinue use of our services.

 

1. Information We Collect

We may collect various types of information from you or about you, either directly or indirectly, as described below.

a. Information You Provide Directly

When you interact with Herit360, you may voluntarily provide certain personal information, including:

  • Account Registration Data. When you sign up for a Herit360 account, we ask for basic information such as your first name, last name, email address, phone number, and a password. If you register as a Vendor, we may also collect additional details such as your business or organization name, identification documents or business registration (to verify legitimacy), and payout information (e.g., bank account or mobile money details for receiving payments).
  • Profile and Travel Details. Users may have the option to complete a profile with information like a profile photo, username, preferred language, home city, and a short bio. If you book services, we may collect details related to your bookings – for example, your travel dates, special requests, or preferences (like dietary restrictions for a dining experience or accommodation preferences). If you participate in certain offerings, such as cultural workshops or events, you might provide information relevant to that activity (e.g., Tshirt size for an event, or your skill level for an activity).
  • Identity Verification Data. For trust and safety, Herit360 might implement identity verification. In such cases, we could ask for documentation or information to confirm your identity – such as a copy of your governmentissued ID (passport or driver’s license) or a selfie photo for facial verification. This is more likely for certain Vendors or for users engaging in highvalue transactions or specific services. We will let you know what information is required and why if such verification is needed.
  • Booking and Transaction Information. When you make or accept bookings through Herit360, we collect information about the transaction. This includes details of the service booked (for example, the property or experience name, location, dates, and price), as well as any communications between the Guest and Vendor regarding the booking. If you are booking a service that requires additional arrangements (for example, requesting a custom itinerary or visa assistance), we may collect information you provide for that purpose. For instance, if you use our Visa on Arrival assistance service, we will collect the personal details needed to process your visa application (such as your full name, passport number, nationality, date of birth, and travel itinerary) and use this information to coordinate with the relevant immigration authorities or partners to secure your visa.
  • Payment Information. We use thirdparty payment processors for handling payments, so we generally do not store your full financial information like credit card numbers on our systems. However, when you make a payment or receive a payout, you provide payment details such as your credit/debit card information or mobile money account and billing address. These details are collected by our payment processing partner. We may store tokens or abbreviated information (e.g., the last four digits of your card, the card network, and expiration date) for recordkeeping and to enable future transactions. For payouts to Vendors, we collect bank account details or mobile money account information to send your earnings.
  • Communications and Support. If you contact us directly (for example, via email at support@herit360.com, customer support chat, or phone), we will receive the contents of your message and any attachments or information you choose to provide. This may include feedback, inquiries, complaints, or requests. We also keep records of our communications with you, including support inquiries and responses.
  • Other Voluntary Information. You may provide information when using certain features: for example, if you fill out a survey, subscribe to our newsletter (providing your email address for marketing communications), participate in promotions, refer friends to Herit360, or submit reviews and ratings. We will collect whatever information you provide in these contexts (such as the content of your review, or the email address of a referred friend—please ensure you have their consent to share it).

b. Information We Collect Automatically

When you use our Platform, we automatically collect certain information about your device and usage, including:

  • Usage Data. We collect details of your interactions with the Platform, such as the pages or screens you view, the features you use, links clicked, time spent on pages, and the dates/times of your visits. For example, we might log that you searched for tours in Accra or viewed a particular hotel listing.
  • Device and Technical Data. We receive data from the devices and browsers you use. This may include your IP address (which can give a general location), device type (e.g., iPhone, Android, desktop), operating system version, app version, browser type (if on web), device identifiers or advertising IDs, language preference, and mobile network information. If you access our website, we may also collect information via cookies and similar technologies (see our Cookie Policy below).
  • Location Information. If you enable location services on the Herit360 mobile app or allow our site to access your location, we may collect precise geolocation data from your device. We would use this to provide locationbased services—such as showing you nearby attractions or listings in your current city. You can control the app’s access to location data via your device settings. If you do not grant permission, the app or site may still infer your approximate location from your IP address (which is less accurate) for basic localization (e.g., suggesting a default region).
  • Cookies and Tracking Technologies. Herit360 uses cookies, web beacons, pixels, and similar tracking tools to enhance your experience and analyze usage of our Platform. Cookies are small text files that websites save on your device to store data about your preferences or actions. For example, we might use cookies to remember your login session, so you don’t have to sign in repeatedly, or to remember your preferred language or currency. We also use cookies/analytics to understand Platform traffic and performance (e.g., Google Analytics may set cookies to collect information on how users navigate our site, so we can improve design and features). Our Cookie Policy (see below) provides more details on these technologies and your choices. By using our site or app with cookies enabled, you agree to our use of cookies as described.
  • Log Data. Like many online services, our servers keep logs of requests. These server logs may include information such as your web request, interactions with the Platform, IP address, browser type, referring/exit pages and URLs, number of clicks, and other such information. We use log data for security monitoring, debugging, and to compile usage trends.

c. Information from Third Parties

We may also receive information about you from other sources, such as:

  • ThirdParty Accounts. If you choose to link or log in to Herit360 through a thirdparty platform (for example, “Sign in with Google” or using an Apple ID), we will receive certain information from that platform, such as your name and email address, as authorized by those external services. We only receive data that you authorize the third party to share with us.
  • Social Media or Advertising Partners. If we run campaigns on social media (e.g., if you click an Instagram or Facebook ad for Herit360 and then sign up), those platforms might send us data for campaign effectiveness, such as aggregated demographic info or how you interacted with our ad. If you publicly mention or tag Herit360 on social media, we might see your post through those services (but we will handle any such information in accordance with this Policy).
  • Travel or Business Partners. We might receive information from partner organizations or affiliates. For instance, if Herit360 partners with a tourism board, an airline, or a university program to offer special experiences, they might share with us a list of eligible participants or basic contact information of referrals (with appropriate consent). Another example: if a Vendor is an established company, they might share data of bookings made outside our platform to sync calendars or availability. Any thirdparty sharing will only be done where legally permitted and typically with your knowledge.
  • Background or Security Checks. To the extent permitted by law and with your consent when required, Herit360 may obtain background check reports or screenings for Vendors (or sometimes for users engaging in highrisk activities). These reports could provide information such as verification of identity, criminal record checks, or confirmation of professional licenses. We use such information solely for safety vetting and as required by law. We will inform you and obtain consent as needed before requesting such reports.
  • Other Users. Sometimes, other users of the Platform may provide information about you. For example, a user who is booking an experience may add you as a guest in the booking, providing your name and email to include you in the reservation. Or a friend might refer you to the Platform by giving us your email address to send an invite (in which case we would use that information only for the referral and delete it if not used for another purpose). If you are a Vendor, users who have had experiences with you may leave reviews or feedback that include information about their interaction with you.

We treat all such collected information according to this Privacy Policy and any applicable law. Where information is combined (for example, linking your social media profile picture to your Herit360 account), we handle it as personal data under this Policy.

 

 

2. How We Use Your Information

Herit360 uses the collected information for the following purposes:

  • Providing and Improving Our Services. We use your information to operate the Platform and provide you with the services you request. This includes using data to create and maintain your account, enable you to browse and book listings, enable Vendors to list and manage their offerings, process transactions and send booking confirmations, and generally facilitate the overall experience (for example, using your information to generate itineraries or personalized recommendations for you). We also analyze usage to improve our platform’s functionality, user interface, and offerings. Usage data and feedback help us identify bugs, optimize performance, and develop new features or services that better serve our users’ needs.
  • Facilitating Bookings and Transactions. We use personal data to ensure that bookings and purchases go smoothly. For example, we will use the information of a user and a Vendor to allow them to communicate regarding a booking (through our messaging system, we relay messages or enable calls as needed without necessarily sharing actual phone numbers unless users choose to share them). We share necessary details with the Vendor once you book (such as your name, the names of other guests in your party, and the contact information you’ve provided) so they can prepare for your arrival or deliver the service. Payment data is used to charge users and pay out vendors, including calculating any applicable taxes or conversion of currency.
  • Communication. We may use your contact information (email, phone number) to send you servicerelated communications. These include booking confirmations and updates, payment receipts, itineraries, account verification codes, and important notices about your account or transactions (for example, if a host messages you, if a booking is canceled or changed, or if we have updates to our terms or policies). We might also send you customer support messages in response to your inquiries. Some of these communications are necessary as part of our contractual obligations (for example, sending a confirmation email when you book). We may also send you promotional communications about new features, special offers, or travel inspiration if you have opted in to such communications. You can always opt out of marketing emails by using the unsubscribe link in those emails or adjusting your account preferences. (Transactional or service messages, however, may still be sent as needed.)
  • Marketing and Personalization. With your consent where required, we use your information for marketing purposes. This could include sending you newsletters or promotional emails if you subscribed; showing you targeted advertisements on thirdparty platforms like Google, Facebook, or Instagram (for instance, we might use a hashed version of your email to help show you relevant ads on those platforms, or use cookies to retarget you with ads related to places you searched on Herit360); or customizing the content we show you on our own Platform. For example, if you frequently search for cultural events, we might highlight upcoming festivals on the homepage for you. If you indicated an interest in Ghanaian history, we might send recommendations about historical tours. You have choices in this: you can adjust your notification and cookie preferences to limit certain types of personalization.
  • Analytics and Product Development. We use aggregated and analytic data to understand trends and user behavior. This helps us make informed decisions about our business. For instance, we analyze which cities are most searched, what times of year are popular for certain types of experiences, or how users navigate the app. This information guides our decisions on where to expand offerings or how to improve the user interface. We may use thirdparty analytics providers (like Google Analytics) to assist with this, which might involve sharing some usage data with those providers (they act on our instructions and cannot use the data for their own purposes).
  • Safety and Trust. Keeping our community safe is a top priority. We may use personal information to screen users and listings for fraud, security, or legal compliance. For example, we might crossreference user data with public records or thirdparty databases to verify identity or check against sanctions lists (as required for payments). We monitor communications on the Platform for red flags (such as someone attempting to send a bank account directly to bypass our system, or harassment in messages). We also use data to detect and prevent fraud or other activities that violate our policies or are illegal – this can include detecting multiple accounts, payment fraud, or suspicious booking patterns. If we find potential misconduct, we will investigate and, if necessary, take action such as warnings, account suspension, or reporting to authorities.
  • Legal and Compliance. We may process personal data as required to comply with our legal obligations. This includes fulfilling duties under consumer protection laws; adhering to financial regulations (for example, maintaining transaction records for accounting and tax purposes); responding to lawful requests by public authorities or law enforcement; and ensuring compliance with data protection laws (for instance, honoring optout requests or user data rights). If you are a Vendor, we may use your information to assist with compliance with local laws (for example, if a city requires registration of shortterm rentals). For certain services like the Visa on Arrival assistance, we use your provided personal data to fulfill a legal process (submitting it to Ghanaian immigration or relevant government agencies to obtain your visa approval on your behalf).
  • Community Features and Social Interaction. If our Platform includes community features like forums, blogs, or social networking aspects, any information you post there (including profile information that is set to public) may be used to facilitate interaction. For example, if you ask a question on a public forum, we and other users can see your provided details and respond. We might also highlight contributions by users (for example, featuring a particularly good review or travel story on our blog or social media, with your permission or if it’s posted publicly).
  • Business Transfers. In the event that Herit360 is involved in a merger, acquisition, investment due diligence, reorganization, bankruptcy, or sale of all or some of our assets, your information may be transferred to or shared with the involved parties as part of evaluating or executing that transaction. If such a transfer occurs, the use of your personal data will be governed by this Privacy Policy as it may be updated, and any material changes will be communicated to you.
  • Legal Bases for Processing (EU/UK users). Where required, we process personal data only when we have a valid legal basis. These include: performance of a contract (to provide you the services you asked for), legitimate interests (to improve services, prevent fraud, and enhance security), compliance with legal obligations (such as financial recordkeeping or responding to lawful requests), and your consent (for optional uses like marketing communications or certain cookies). When we rely on consent, we will make that clear at the point of collection and you may withdraw your consent at any time (though this will not affect processing already carried out).

 

3. How We Share Your Information

Herit360 is not in the business of selling personal information. We share your information only in the following circumstances:

  • With Vendors and Other Users. When you make a booking or interact via the Platform, appropriate information needs to be exchanged to fulfill the service. If you are a user booking a service, we will share relevant details with the Vendor, such as your name, the names of any additional guests, your contact phone number (if provided), and any special requests. If you are a Vendor, information from your profile and listing (such as your first name, general hosting location, and profile photo) will be visible to users. After a booking is confirmed, users and Vendors will see more contact details of each other to coordinate. Payment information is not shared with other users; all payments are processed securely through Paystack and only the necessary payout amount is sent to the Vendor.
  • Public Content. If you post content in a public area of the Platform—such as writing a review or creating a public profile as a tour guide—that content will be visible to others. For example, your reviews for experiences will display your first name, your profile photo (if you have one), and your general location or other public profile info you have provided. Public forum posts or social features will be visible to others on the Platform.
  • Service Providers and Partners. We use trusted thirdparty companies to perform certain functions on our behalf to operate and improve our services. These service providers only receive the information necessary for them to carry out their tasks, and they are contractually obligated to protect your data and use it only for the purposes we specify. Examples include:
  • Payment processors (e.g., Paystack) that handle financial transactions.

·      Cloud hosting providers and IT infrastructure services that store and process data on our behalf.

·      Email and communication tools to send transactional emails or verification codes.

·      Analytics and marketing platforms that set cookies and process usage data (e.g., Google Analytics).

·      Verification and security vendors for identity verification and fraud prevention.

·      Customer support tools (e.g., CRM systems) to manage user support inquiries.

  • Business partners who may provide complementary services (e.g., travel insurance providers). We will share only the information necessary for the partner to provide the service.
  • Legal Compliance and Protection. We may disclose your information when we believe in good faith that such disclosure is necessary to:
  • Comply with a legal obligation or request (such as a court order or subpoena);

·      Enforce our Terms and other agreements or investigate potential violations thereof;

·      Detect, prevent, or address fraud, security, or technical issues;

  • Protect the rights, property, or safety of Herit360, our users, or the public (for example, fraud protection and credit risk reduction).
  • Corporate Transactions. If Herit360 is involved in a merger, acquisition, restructuring, or sale of assets, your information may be transferred as part of the transaction. We will ensure the confidentiality of any personal data involved and provide notice before your personal data is transferred and becomes subject to a different privacy policy.
  • Aggregated or Deidentified Data. We may share information that has been aggregated or deidentified so that it can no longer be used to identify you. Such information is used for purposes like industry analysis, demographic profiling, and marketing.

We do not sell your personal data. Ghana’s Data Protection Act prohibits the sale and purchase of personal data, and we adhere to that principle. If we ever need to share your information for a purpose not covered above, we will do so only with your consent.

4. Cookies and Tracking Technologies

Our use of cookies and similar technologies is explained in detail in our Cookie Policy. In brief, Herit360 uses cookies to provide essential functionality (such as maintaining login sessions), to understand and improve user experience (through analytics), and to offer personalized content or advertising (with your consent where required). We may also use pixels or SDKs in our app to measure conversion or send you notifications. You have control over cookies and can manage them through your browser or device settings. However, disabling cookies might affect Platform functionality (for example, the site might not remember your preferences or might require you to log in repeatedly). For more details, please refer to the Cookie Policy below.

 

5. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected and to comply with legal or regulatory requirements. This means:

  • Active Account Data. If you have an account with Herit360, we keep your account information, profile, and content for as long as your account is active. Once you close your account or it is terminated, we will begin deleting or anonymizing your personal data. However, we may retain certain information for legitimate purposes such as responding to disputes, enforcing our Terms, or complying with legal obligations. For example, we may keep transaction records and correspondence for a number of years as required by tax law or for audit purposes.
  • Bookings and Transactions. Information related to bookings, payments, and communications with Vendors may be retained to maintain accurate financial and service records. Even if you delete your account, we may retain booking history associated with that account for accounting and fraud prevention purposes. However, such data would be disassociated from your personal profile once the account is deleted.
  • Legal Requirements. We might also retain data for certain statutory retention periods. For example, in Ghana, financial transaction records might need to be kept for a minimum number of years. Similarly, if we collected passport information for a visa service or for a regulatory requirement, we would keep that as long as necessary to comply with immigration or legal record rules, and then securely delete it.
  • Backup and Archival. Even after deletion from our active database, residual copies might persist in backup systems for a short period (due to the nature of backups and caching). We have processes to eventually overwrite or delete backup data as well, in accordance with our data retention and deletion policies.
  • Anonymized Data. In some cases, rather than completely deleting data, we may anonymize it so that it no longer can be linked to you and use it for analytical purposes.

When personal data is no longer needed, we will ensure it is either securely deleted or stored in a way that it can no longer be attributed to an identifiable individual.

 

6. Your Rights and Choices

Depending on your jurisdiction and subject to applicable law, you may have certain rights regarding your personal data. Herit360 is committed to enabling these rights as appropriate:

  • Access and Portability. You have the right to request a copy of the personal information we hold about you. We can provide this in a commonly used electronic form. For example, you can ask us to confirm if we are processing your personal data and to send you a copy of your profile details and booking history. EU users have this right under GDPR.
  • Correction (Rectification). We strive to keep your information accurate. If you find that any personal data we have is incorrect or incomplete, you have the right to request that we correct it. You can also directly update some of your information by logging into your account.
  • Deletion (Erasure). You may request that we delete your personal data (“right to be forgotten”). For example, if you no longer want to use Herit360, you can ask us to delete all personal information we have about you. We will do so unless we are required to retain certain data by law or if the data is needed for legitimate business purposes (as described in the Data Retention section).
  • Objection to Processing. You have the right to object to certain types of processing. For instance, you can object to processing of your data for direct marketing purposes. If you object, we will stop processing your data for that purpose. In other cases, if we are processing your data based on legitimate interests, you can object and provide reasons related to your situation. We will consider your objection and stop or adjust processing unless we have compelling legitimate grounds to continue or if it’s needed for legal claims.
  • Restriction of Processing. You can request that we restrict processing of your data in certain situations, such as while we are verifying the accuracy of data you contested or if you want to preserve data for a legal claim but not actively use it. If processing is restricted, we will store the data but not use it until the restriction is lifted (except for certain necessary tasks).
  • Withdrawal of Consent. Where we rely on your consent to process information (such as for sending promotional emails or collecting certain cookies), you have the right to withdraw that consent at any time. For example, you can unsubscribe from marketing emails through the provided link. Withdrawing consent will not affect the lawfulness of processing already carried out, but it will stop the future processing of the relevant data. If you withdraw consent for something like location services on the app or certain data collection, some features may no longer function properly.
  • Data Portability. For data that you have provided to us and that we process by automated means based on your consent or in performance of a contract, you can request that we provide it to you (or a third party) in a structured, commonly used, machinereadable format.
  • Complaint to a Regulator. We hope to resolve any questions or concerns you have about our use of your data directly. However, if you believe we have not adequately addressed your privacy concerns, you have the right to lodge a complaint with the relevant data protection authority. For instance, in Ghana, the Data Protection Commission is the regulatory body; in the EU, you would contact the supervisory authority in your country of residence. We will provide the contact information for the appropriate authority upon request.

7. Security Measures

Herit360 takes security seriously and implements a variety of technical and organizational measures to protect your personal data from unauthorized access, alteration, disclosure, or destruction. These include:

  • Encryption. We use encryption protocols to protect data in transit. For example, our website and app use HTTPS to encrypt information exchanged between your browser/app and our servers. Sensitive data like passwords are typically stored hashed and not in plain text. Payment information is handled securely by payment processors, and any stored payment tokens are safeguarded.
  • Secure Payment Processing. Every transaction on Herit360 is encrypted and securely processed through trusted payment gateways such as Paystack. We partner only with PCIDSS compliant payment providers that specialize in secure payment handling. We do not store full credit card numbers on our systems to reduce risk.
  • Access Controls. We limit access to personal data to authorized employees, contractors, and service providers who need to know that information in order to process it for us, and who are subject to strict confidentiality obligations. Our staff is trained on data protection practices and is aware of their responsibility to safeguard your data.
  • Firewalls and Network Security. Our servers are protected by firewalls and monitored for potential vulnerabilities or attacks. We regularly update our systems and apply security patches to guard against threats. We also employ antivirus and antimalware solutions where appropriate.
  • Monitoring and Testing. We monitor our Platform for suspicious activities and have systems to detect and prevent brute force login attempts or other malicious behavior. Regular security audits and penetration testing (whether internally or by thirdparty experts) are conducted to evaluate and improve our security posture.
  • Data Backups and Recovery. We maintain secure backup routines to ensure data resilience. We strive to protect your personal data, but we cannot guarantee absolute security. You can also play a part in safeguarding your data by maintaining a strong, unique password for your Herit360 account, not sharing your account credentials, and logging out after use on shared devices. 8. International Data Transfers

Herit360 is a Ghanaian company, but the nature of our business means that personal information may be transferred to or accessed by entities around the world. If you are using our Platform from outside Ghana, be aware that your data will likely be transferred to and processed in Ghana and possibly other countries where our servers or service providers are located, including the United States or countries in the European Union. We recognize that different countries may have different data protection laws. When we transfer personal data internationally, we take steps to ensure that appropriate safeguards are in place to protect your information in accordance with this Privacy Policy and applicable law.   • Contractual Clauses.   • Other Frameworks. While some frameworks (such as the U.S.-EU Privacy Shield) have been invalidated, we ensure that any USbased providers we use commit to strong data protection practices and, if applicable, have alternative compliance measures in place.
  • Ghana’s Requirements. Ghana’s Data Protection Act requires that data controllers ensure foreign data is processed in compliance with that person’s home data protection laws when transferring data to Ghana. We interpret this as a commitment to uphold the privacy rights of international users in line with their jurisdiction.

By using our Platform or submitting your information to us, you acknowledge that your data may be transferred to countries outside of your country of residence. While those countries may have different or less stringent data protection rules than your own country, we will continue to protect your personal information as described in this Policy. Herit360’s services are not directed to children (typically defined as individuals under the age of 18). For example, a family may book a trip through Herit360, but the account and any data entry should be done by a parent or guardian, and any child participation in experiences should be with adult permission and oversight. If you are under 18, please do not attempt to register an account or send any personal information about yourself to us. If we learn that we have inadvertently collected personal data from a child under 18, we will take steps to delete that information promptly. Parents or guardians: If you become aware that your child has provided us with personal information without your consent, please contact us at support@herit360.com so that we can delete the information and terminate the child’s account (if applicable). In cases where certain experiences or services offered through Herit360 are specifically educational or childfriendly (such as a cultural workshop for students), those will always require that a teacher, parent, or guardian registers and provides any necessary data on behalf of the child. Any such information collected will be handled with special care and deleted when no longer needed for the service.

  • Herit360 Preferences Cookie (example: herit360_pref). A firstparty persistent cookie to remember your preferences (such as language selection or whether you dismissed an introductory tour popup). Expires after several months or a year.
  • CSRF Token Cookie (example: csrftoken). A security cookie to prevent crosssite request forgery, ensuring that form submissions or actions come from your device.
  • Google Analytics Cookies (e.g., _ga, _gid, _gat). Thirdparty cookies provided by Google, Inc. These are used to collect information about how visitors use our site.   • Profile and Travel Details. Users may have the option to complete a profile with information like a profile photo, username, preferred language, home city, and a short bio. If you book services, we may collect details related to your bookings – for example, your travel dates, special requests, or preferences (like dietary restrictions for a dining experience or accommodation preferences). If you participate in certain offerings, such as cultural workshops or events, you might provide information relevant to that activity (e.g., Tshirt size for an event, or your skill level for an activity).
  • Identity Verification Data. For trust and safety, Herit360 might implement identity verification. In such cases, we could ask for documentation or information to confirm your identity – such as a copy of your governmentissued ID (passport or driver’s license) or a selfie photo for facial verification. For instance, if you use our Visa on Arrival assistance service, we will collect the personal details needed to process your visa application (such as your full name, passport number, nationality, date of birth, and travel itinerary) and use this information to coordinate with the relevant immigration authorities or partners to secure your visa.
  • Payment Information. We use thirdparty payment processors for handling payments, so we generally do not store your full financial information like credit card numbers on our systems. However, when you make a payment or receive a payout, you provide payment details such as your credit/debit card information or mobile money account and billing address. These details are collected by our payment processing partner. We may store tokens or abbreviated information (e.g., the last four digits of your card, the card network, and expiration date) for recordkeeping and to enable future transactions. For payouts to Vendors, we collect bank account details or mobile money account information to send your earnings.
  • Communications and Support. If you contact us directly (for example, via email at support@herit360.com, customer support chat, or phone), we will receive the contents of your message and any attachments or information you choose to provide. This may include feedback, inquiries, complaints, or requests. We also keep records of our communications with you, including support inquiries and responses.

  • Other Users. Sometimes, other users of the Platform may provide information about you. For example, a user who is booking an experience may add you as a guest in the booking, providing your name and email to include you in the reservation. Or a friend might refer you to the Platform by giving us your email address to send an invite (in which case we would use that information only for the referral and delete it if not used for another purpose). If you are a Vendor, users who have had experiences with you may leave reviews or feedback that include information about their interaction with you.

We treat all such collected information according to this Privacy Policy and any applicable law. Where information is combined (for example, linking your social media profile picture to your Herit360 account), we handle it as personal data under this Policy.

We also analyze usage to improve our platform’s functionality, user interface, and offerings. Usage data and feedback help us identify bugs, optimize performance, and develop new features or services that better serve our users’ needs.
  • Facilitating Bookings and Transactions. We use personal data to ensure that bookings and purchases go smoothly. For example, we will use the information of a user and a Vendor to allow them to communicate regarding a booking (through our messaging system, we relay messages or enable calls as needed without necessarily sharing actual phone numbers unless users choose to share them). We share necessary details with the Vendor once you book (such as your name, the names of other guests in your party, and the contact information you’ve provided) so they can prepare for your arrival or deliver the service. Payment data is used to charge users and pay out vendors, including calculating any applicable taxes or conversion of currency.
  • Communication. We may use your contact information (email, phone number) to send you servicerelated communications. These include booking confirmations and updates, payment receipts, itineraries, account verification codes, and important notices about your account or transactions (for example, if a host messages you, if a booking is canceled or changed, or if we have updates to our terms or policies). We might also send you customer support messages in response to your inquiries. Some of these communications are necessary as part of our contractual obligations (for example, sending a confirmation email when you book). We may also send you promotional communications about new features, special offers, or travel inspiration if you have opted in to such communications. You can always opt out of marketing emails by using the unsubscribe link in those emails or adjusting your account preferences. (Transactional or service messages, however, may still be sent as needed.)

We monitor communications on the Platform for red flags (such as someone attempting to send a bank account directly to bypass our system, or harassment in messages). If we find potential misconduct, we will investigate and, if necessary, take action such as warnings, account suspension, or reporting to authorities.

This includes fulfilling duties under consumer protection laws; adhering to financial regulations (for example, maintaining transaction records for accounting and tax purposes); responding to lawful requests by public authorities or law enforcement; and ensuring compliance with data protection laws (for instance, honoring optout requests or user data rights). If you are a Vendor, we may use your information to assist with compliance with local laws (for example, if a city requires registration of shortterm rentals). For certain services like the Visa on Arrival assistance, we use your provided personal data to fulfill a legal process (submitting it to Ghanaian immigration or relevant government agencies to obtain your visa approval on your behalf).
  • Community Features and Social Interaction. If our Platform includes community features like forums, blogs, or social networking aspects, any information you post there (including profile information that is set to public) may be used to facilitate interaction. For example, if you ask a question on a public forum, we and other users can see your provided details and respond. We might also highlight contributions by users (for example, featuring a particularly good review or travel story on our blog or social media, with your permission or if it’s posted publicly).
  • Business Transfers. In the event that Herit360 is involved in a merger, acquisition, investment due diligence, reorganization, bankruptcy, or sale of all or some of our assets, your information may be transferred to or shared with the involved parties as part of evaluating or executing that transaction. If such a transfer occurs, the use of your personal data will be governed by this Privacy Policy as it may be updated, and any material changes will be communicated to you.
  • Legal Bases for Processing (EU/UK users). Where required, we process personal data only when we have a valid legal basis. These include: performance of a contract (to provide you the services you asked for), legitimate interests (to improve services, prevent fraud, and enhance security), compliance with legal obligations (such as financial recordkeeping or responding to lawful requests), and your consent (for optional uses like marketing communications or certain cookies). When we rely on consent, we will make that clear at the point of collection and you may withdraw your consent at any time (though this will not affect processing already carried out).

 

3. How We Share Your Information

Herit360 is not in the business of selling personal information. We share your information only in the following circumstances:

  • With Vendors and Other Users. When you make a booking or interact via the Platform, appropriate information needs to be exchanged to fulfill the service. If you are a user booking a service, we will share relevant details with the Vendor, such as your name, the names of any additional guests, your contact phone number (if provided), and any special requests. If you are a Vendor, information from your profile and listing (such as your first name, general hosting location, and profile photo) will be visible to users. After a booking is confirmed, users and Vendors will see more contact details of each other to coordinate. Payment information is not shared with other users; all payments are processed securely through Paystack and only the necessary payout amount is sent to the Vendor.
  • Public Content. If you post content in a public area of the Platform—such as writing a review or creating a public profile as a tour guide—that content will be visible to others. For example, your reviews for experiences will display your first name, your profile photo (if you have one), and your general location or other public profile info you have provided. Public forum posts or social features will be visible to others on the Platform.
  • Service Providers and Partners. We use trusted thirdparty companies to perform certain functions on our behalf to operate and improve our services. These service providers only receive the information necessary for them to carry out their tasks, and they are contractually obligated to protect your data and use it only for the purposes we specify. Examples include:
  • Payment processors (e.g., Paystack) that handle financial transactions.

·      Cloud hosting providers and IT infrastructure services that store and process data on our behalf.

·      Email and communication tools to send transactional emails or verification codes.

·      Analytics and marketing platforms that set cookies and process usage data (e.g., Google Analytics).

·      Verification and security vendors for identity verification and fraud prevention.

We do not sell your personal data. Ghana’s Data Protection Act prohibits the sale and purchase of personal data, and we adhere to that principle. If we ever need to share your information for a purpose not covered above, we will do so only with your consent.

4. Cookies and Tracking Technologies

Our use of cookies and similar technologies is explained in detail in our Cookie Policy. In brief, Herit360 uses cookies to provide essential functionality (such as maintaining login sessions), to understand and improve user experience (through analytics), and to offer personalized content or advertising (with your consent where required). We may also use pixels or SDKs in our app to measure conversion or send you notifications. You have control over cookies and can manage them through your browser or device settings. However, disabling cookies might affect Platform functionality (for example, the site might not remember your preferences or might require you to log in repeatedly). 5. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected and to comply with legal or regulatory requirements. This means:

  • Active Account Data. If you have an account with Herit360, we keep your account information, profile, and content for as long as your account is active. Once you close your account or it is terminated, we will begin deleting or anonymizing your personal data. However, we may retain certain information for legitimate purposes such as responding to disputes, enforcing our Terms, or complying with legal obligations. For example, we may keep transaction records and correspondence for a number of years as required by tax law or for audit purposes.
  • Bookings and Transactions. Information related to bookings, payments, and communications with Vendors may be retained to maintain accurate financial and service records. Even if you delete your account, we may retain booking history associated with that account for accounting and fraud prevention purposes. However, such data would be disassociated from your personal profile once the account is deleted.
  • Legal Requirements. We might also retain data for certain statutory retention periods. For example, in Ghana, financial transaction records might need to be kept for a minimum number of years. Similarly, if we collected passport information for a visa service or for a regulatory requirement, we would keep that as long as necessary to comply with immigration or legal record rules, and then securely delete it.
  • Backup and Archival. Even after deletion from our active database, residual copies might persist in backup systems for a short period (due to the nature of backups and caching). We have processes to eventually overwrite or delete backup data as well, in accordance with our data retention and deletion policies.
  • Anonymized Data. In some cases, rather than completely deleting data, we may anonymize it so that it no longer can be linked to you and use it for analytical purposes.

When personal data is no longer needed, we will ensure it is either securely deleted or stored in a way that it can no longer be attributed to an identifiable individual.

 

6. Your Rights and Choices

Depending on your jurisdiction and subject to applicable law, you may have certain rights regarding your personal data. Herit360 is committed to enabling these rights as appropriate:

  • Access and Portability. You have the right to request a copy of the personal information we hold about you. We can provide this in a commonly used electronic form. For example, you can ask us to confirm if we are processing your personal data and to send you a copy of your profile details and booking history. EU users have this right under GDPR.
  • Correction (Rectification). We strive to keep your information accurate. If you find that any personal data we have is incorrect or incomplete, you have the right to request that we correct it. You can also directly update some of your information by logging into your account.
  • Deletion (Erasure). You may request that we delete your personal data (“right to be forgotten”). For example, if you no longer want to use Herit360, you can ask us to delete all personal information we have about you. We will do so unless we are required to retain certain data by law or if the data is needed for legitimate business purposes (as described in the Data Retention section).
  • Objection to Processing. You have the right to object to certain types of processing. For instance, you can object to processing of your data for direct marketing purposes. If you object, we will stop processing your data for that purpose. In other cases, if we are processing your data based on legitimate interests, you can object and provide reasons related to your situation. We will consider your objection and stop or adjust processing unless we have compelling legitimate grounds to continue or if it’s needed for legal claims.
  • Restriction of Processing. You can request that we restrict processing of your data in certain situations, such as while we are verifying the accuracy of data you contested or if you want to preserve data for a legal claim but not actively use it. If processing is restricted, we will store the data but not use it until the restriction is lifted (except for certain necessary tasks).
  • Withdrawal of Consent. Where we rely on your consent to process information (such as for sending promotional emails or collecting certain cookies), you have the right to withdraw that consent at any time. For example, you can unsubscribe from marketing emails through the provided link. Withdrawing consent will not affect the lawfulness of processing already carried out, but it will stop the future processing of the relevant data. If you withdraw consent for something like location services on the app or certain data collection, some features may no longer function properly.
  • Data Portability. For data that you have provided to us and that we process by automated means based on your consent or in performance of a contract, you can request that we provide it to you (or a third party) in a structured, commonly used, machinereadable format.

7. Security Measures

Herit360 takes security seriously and implements a variety of technical and organizational measures to protect your personal data from unauthorized access, alteration, disclosure, or destruction. These include:

  • Encryption. We use encryption protocols to protect data in transit. For example, our website and app use HTTPS to encrypt information exchanged between your browser/app and our servers. Sensitive data like passwords are typically stored hashed and not in plain text. Payment information is handled securely by payment processors, and any stored payment tokens are safeguarded.
  • Secure Payment Processing. Every transaction on Herit360 is encrypted and securely processed through trusted payment gateways such as Paystack. We partner only with PCIDSS compliant payment providers that specialize in secure payment handling. We do not store full credit card numbers on our systems to reduce risk.
  • Access Controls. We limit access to personal data to authorized employees, contractors, and service providers who need to know that information in order to process it for us, and who are subject to strict confidentiality obligations. Our staff is trained on data protection practices and is aware of their responsibility to safeguard your data.
  • Firewalls and Network Security. Our servers are protected by firewalls and monitored for potential vulnerabilities or attacks. We regularly update our systems and apply security patches to guard against threats. We also employ antivirus and antimalware solutions where appropriate.

Backups are stored encrypted and separately so that in the event of a hardware failure or other issue, we can recover information. If we detect anomalies (such as multiple failed login attempts or unusual booking patterns), we may take protective actions such as verifying with the user or temporarily freezing actions until we ensure everything is legitimate.

Despite all these precautions, no method of transmission over the internet or method of electronic storage is entirely secure. We strive to protect your personal data, but we cannot guarantee absolute security. You can also play a part in safeguarding your data by maintaining a strong, unique password for your Herit360 account, not sharing your account credentials, and logging out after use on shared devices. If you suspect any unauthorized access to your account or any security vulnerabilities, please contact us immediately. In the unlikely event of a data breach that poses significant risks to your rights and freedoms, we will notify you and the relevant authorities as required by law.

 

8. International Data Transfers

Herit360 is a Ghanaian company, but the nature of our business means that personal information may be transferred to or accessed by entities around the world. If you are using our Platform from outside Ghana, be aware that your data will likely be transferred to and processed in Ghana and possibly other countries where our servers or service providers are located, including the United States or countries in the European Union. We recognize that different countries may have different data protection laws. When we transfer personal data internationally, we take steps to ensure that appropriate safeguards are in place to protect your information in accordance with this Privacy Policy and applicable law. These steps may include:

  • Contractual Clauses. If your data originates from a region like the European Economic Area (EEA) or UK, we may rely on the European Commission’s Standard Contractual Clauses or equivalent mechanisms as a legal basis for transfer, which contractually obliges the recipient to protect your data to EU standards.
  • Adequacy Decisions. We may transfer data to countries deemed “adequate” by relevant data protection authorities (meaning they provide an equivalent level of data protection). Ghana is not currently on the EU’s adequacy list, so for EU personal data we would use other measures like standard contractual clauses.
  • Consent. In certain cases, we might ask for your explicit consent to transfer your data abroad, if no other legal transfer mechanism is available and such consent is recognized by law as a valid basis.
  • Other Frameworks. While some frameworks (such as the U.S.-EU Privacy Shield) have been invalidated, we ensure that any USbased providers we use commit to strong data protection practices and, if applicable, have alternative compliance measures in place.
  • Ghana’s Requirements. Ghana’s Data Protection Act requires that data controllers ensure foreign data is processed in compliance with that person’s home data protection laws when transferring data to Ghana. We interpret this as a commitment to uphold the privacy rights of international users in line with their jurisdiction.

By using our Platform or submitting your information to us, you acknowledge that your data may be transferred to countries outside of your country of residence. While those countries may have different or less stringent data protection rules than your own country, we will continue to protect your personal information as described in this Policy. 9. Children’s Privacy

Herit360’s services are not directed to children (typically defined as individuals under the age of 18). We do not knowingly collect personal information from anyone under 18 years old without verifiable parental consent. Our Platform is intended for use by adults (and minors accompanied by adults, where the adult is the account holder and provides supervision). For example, a family may book a trip through Herit360, but the account and any data entry should be done by a parent or guardian, and any child participation in experiences should be with adult permission and oversight. If you are under 18, please do not attempt to register an account or send any personal information about yourself to us. If we learn that we have inadvertently collected personal data from a child under 18, we will take steps to delete that information promptly. Parents or guardians: If you become aware that your child has provided us with personal information without your consent, please contact us at support@herit360.com so that we can delete the information and terminate the child’s account (if applicable). In cases where certain experiences or services offered through Herit360 are specifically educational or childfriendly (such as a cultural workshop for students), those will always require that a teacher, parent, or guardian registers and provides any necessary data on behalf of the child. 3. Examples of Cookies We Use

Below are examples of specific cookies or similar technologies that may be in use on the Herit360 Platform. This list is representative and may be updated as our usage changes:

  • Herit360 Session Cookie (example: herit360_session). A firstparty session cookie used to keep you logged in as you navigate the site and to maintain your session state. Expires when you close your browser.
  • Herit360 Preferences Cookie (example: herit360_pref). A firstparty persistent cookie to remember your preferences (such as language selection or whether you dismissed an introductory tour popup). Expires after several months or a year.
  • CSRF Token Cookie (example: csrftoken). A security cookie to prevent crosssite request forgery, ensuring that form submissions or actions come from your device.
  • Google Analytics Cookies (e.g., _ga, _gid, _gat). Thirdparty cookies provided by Google, Inc. These are used to collect information about how visitors use our site. We use the information to compile reports and to help us improve the site. The cookies collect information anonymously, including the number of visitors to the site, where visitors have come from, and the pages they visited. _ga typically has a 2year expiration and is used to distinguish users; _gid lasts 24 hours; _gat lasts 1 minute and is used to throttle request rate.
  • Facebook Pixel Cookie (example: _fbp). If we use Facebook Pixel for advertisement/analytics, it’s a small piece of code on our site that sets a cookie and tracks conversions or user actions (like clicking a signup button). This helps us measure the effectiveness of Facebook ads and potentially retarget ads on Facebook or Instagram.

  • A/B Testing or Feature Rollout Cookies (e.g., exp_variant). We may sometimes test new features or layouts by showing different versions to some users. A cookie might be used to remember which version of the site you saw, so that you have a consistent experience during your visit and we can measure results.
  • Cookie Consent Cookie (e.g., cookie_consent). To remember your cookie preferences, we use a necessary cookie that stores your choices so we don’t repeatedly ask for consent.

For our mobile app, if we use analytics or advertising SDKs, you can generally opt out of interestbased advertising by enabling “Limit Ad Tracking” on iOS or “Opt out of Ads Personalization” on Android. This informs companies not to use your info for targeted ads. You can also reset your device’s advertising ID. If we send notifications or track location, those can be controlled via the app’s permission settings on your device.
  • Effect of Disabling Cookies. If you disable or delete cookies, please be aware that some parts of our site might not function correctly. For example, you might not be able to log in, your preferences won’t be remembered, and certain features might behave unexpectedly. We will do our best to provide a baseline experience even without optional cookies, but the full range of offerings may require them.
